Limited Liability Indemnity

This page explains what we are and are not responsible for when you use buttwasher.net or buy from Bidet Co UK, a division of Caruso Consulting Co Ltd ("we", "us" or "our"). It is part of our Terms & Conditions and is governed by the law of England and Wales.

What we never limit

Nothing on this page limits or excludes our liability where the law does not allow it. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under the Consumer Protection Act 1987, and for your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If anything below conflicts with those rights, your rights come first.

What we are responsible for

If we break our terms or fail to take reasonable care, we are responsible for loss or damage you suffer that was a foreseeable result. Loss is foreseeable if it was obvious it would happen, or if we both knew it might happen when you placed your order.

Limits on our liability

Subject to the section above:

we are not responsible for loss that was not foreseeable;
we are not responsible for business losses, such as lost profit or income;
we are not responsible for loss or damage caused by fitting a product in a way that does not follow its instructions or the water regulations, by misuse, or by normal wear and tear;
where we are liable, our total liability for a claim is limited to the amount you paid for the goods the claim is about.

Installation and backflow requirements apply to our products that connect to the water supply: follow the product instructions and the water regulations where you live, and use a qualified plumber if you are unsure.

Delays outside our control

If something outside our reasonable control delays or stops your order, we will tell you as soon as we can. If the delay looks like being a long one, you can cancel and we will refund anything you have paid for but not received.

Using the website

We work to keep the website available and the information on it correct, but we cannot promise it will always be available or free of errors. We may change, pause or remove parts of it without notice. Our Disclaimer explains how to read the product information on the site.

Your indemnity

If you deliberately misuse the website or break our Terms & Conditions, for example by trying to break into the site or by copying our content, you may have to cover the losses, costs and claims we face as a result. We will only ask you to cover losses that were a reasonably foreseeable result of what you did.

This never applies to using a product the way its instructions describe, or to using your rights as a consumer.
